Advocate Mediation- How We Can Help
When mediation fails to resolve the conflict, the matter will be brought to the family law court.
Here, a judge will decide on the case. Going to court is a process that will take months or even years to resolve, besides the fact that it is very stressful and expensive. Mediation aims to help family members to resolve their issue within themselves and not allow their situation to reach this point.
The issue on childcare can also be emotionally disturbing, not only with regards to separated parents, but most importantly on the child. The family law encourages parents to agree among themselves how to care for their children, without bringing the problem to court. The matter can be discussed between the two of them or they can request a family member or a friend to help. If they want to do it in a formal process, they can involve the services of a family mediator. The mediator shall not take sides or favour one party, over the other, in recommending a resolution.
When people are in conflict and they try to resolve a disagreement in front of a neutral person, this process is called mediation.
Families that are separated by disputes are advised to use family mediation to solve their problem regarding their children, finances, family business and other matters, instead of using a court of law.
Mediation processes can be done by having a family member or a friend helping in the resolution of the issues. It can be done (informally) or it can involve a professional mediator taking charge of the discussion (formally), like the team at Advocate Mediation.
What Situations Can Professional Mediators Be Helpful In?
Dispute resolution methods used by professional mediators can be helpful in the following situations:
- The family has a major communication breakdown
- One or more family members feel that their sides are not being considered
- One or both parties of the disagreement are not willing to settle the dispute by mutual concession
- A couple undergoing a divorce or separation
- A couple would want to get back together after a divorce or separation
- A family with a loved one, who is suffering from a psychological or serious physical issue (for example: an addiction to drugs, alcohol, etc).
Family mediators act as impartial guides, not supporting or siding either side of the conflict. They lead meaningful discussions, trying to make high tensions and emotions, less harsh or hostile, to bring about an effective discussion and decision-between all the parties.
At Advocate Mediation we have mediators that are trained and thus have become experts in the different legal areas of practice. The parties in disagreement will be guided through the mediation process and work with them in making the process as straightforward as possible. With our mediators, both sides can expect the possibility of reaching an acceptable compromise.
